we will bargain together

Dear Members,

Despite our numerous requests, the dogged attempts by NSW Trains and Sydney Trains to progress separate bargaining for our Enterprise Agreement continued today.

Again, the Combined Rail Union attempted to progress good faith bargaining, despite the evident lack of respect from management. NSW Trains and Sydney Trains have continued to refuse to attend a combined meeting with all of your EA Delegates to hear about our whole log of claims for all the members we represent.

With our application for a protected action ballot order still outstanding, we wrote to

Sydney Trains before the meeting and requested that they use today’s meeting to take your representatives through their log of claims.

Here’s what happened:

  • Sydney Trains did not put forward their log of claims, despite being repeatedly asked to. At this point, it is hard to believe that one even exists.
  • There was very little substance put forward just a range of motherhood statements including flexibility, modernisation and something about “customer at the heart”.
  • Management had the audacity to then ask a range of questions about detailed specifics of the Combined Rail Union (CRU) Log of Claims, while deliberately avoiding providing any details about what they want from this Enterprise Agreement.
  • They once again reiterated that 0.3% was on the table for the first year and it would not be increased without employee-related cost savings.

From what we saw today, we can only assume the bargaining meetings are being used as a bad faith stalling tactic by Sydney Trains. It is now abundantly clear we will need to take strong collective action to progress negotiations.

This Friday, we will be back in the Fair Work Commission providing final submissions as we fight for our right to take protected action. NSW Trains and Sydney Trains are sparing no expense in fighting and delaying the application and by association the bargaining process.
